EBRD UNCITRAL Initiative held meetings to discuss draft amendments to Armenian PPL PRINT E-mail


meeting2 [12/10/2015] Olivier Moreau and Eriks Mezalis took a mission to Geneva 14-18 September 2015.

The aim of the meeting was to discuss the draft amendments to Armenian Public Procurement Law (PPL) with the representatives of Ministry of Finance of  Armenia and OECD/Sigma. Delegates from the Ministry of Finance of Armenia took part in the WTO GPA Workshop  that was held in Geneva on 16-18 September.

At the meeting with Sergey Shahnazaryan, Head of PIFC and PP Methodology Department of the Ministry of Finance of Armenia and Marian Lemke, Senior Adviser of OECD/Sigma, EBRD experts Olivier Moreau, Eriks Mezalis and Astghik Solomonyan discussed the comments from OECD/Sigma and Ministry of Finance of Armenia on the draft amendments to Armenian PPL elaborated by the EBRD experts team.

The discussion of the comments provided by OECD/Sigma mainly concentrated on the provisions regarding new public procurement review body. Marian Lemke suggested that existing provisions of the draft amendments regarding the review body should be supplied with provisions on administrative staff of the review body, the sources of funding its activities, status of the Procurement Support Center in the transition period and others.

Comments from the Ministry of Finance mostly concerned such issues as the definition section of the amended draft PPL, time limits for submission of tenders, provisions on structuring the subject matter of the contract, possibilities for review body to apply interim measures rather than imposing automatic standstill after the complaint submission.

All the parties are willing to proceed with the draft amendments to Armenian PPL as swiftly as possible.

It was agreed that the EBRD experts team will incorporate the comments in the second version of the draft amendments to Armenian PPL and submit them to the Ministry of Finance of Armenia until 15 October 2015.
