OSCE, EBRD UNCITRAL Initiative Regional Seminar, Vienna PRINT E-mail

On 28-29 May 2015 the European Bank for Reconstruction and Development (EBRD) Legal Transition Programme in cooperation with the United Nations Commission on International Trade Law (UNCITRAL) and the OSCE / Office of the Co-ordinator of OSCE Economic and Environmental Activities held a regional seminar on enhancing public procurement regulation.

The seminar gathered together public procurement policy makers from 16 invited countries which are participating in the Initiative:

 

Armenia, Azerbaijan, Belarus, Egypt, Jordan, Kazakhstan, the Kyrgyz Republic, Moldova, Mongolia, Morocco, the Russian Federation, Tajikistan, Tunisia, Turkey, Turkmenistan and Ukraine, for specialised technical co-operation event dedicated to promoting transparency safeguards in public procurement policies, as a means to prevent corruption and promote economic development.

The meeting aimed at key public procurement policy officials responsible for developing new laws in the countries, in order to strengthen their capacity to effectively implement transparency safeguards and the public procurement review in particular.

It consisted of a Political and Technical segments. It started with discussing the role of improving public procurement procedures for economic development and combating corruption, then it focused on the current status of review procedures in the region. The Regional Seminar was interactive and based on case presentations, including a case study of the Austrian public procurement review system. Participants shared experiences and asked questions and challenged conclusions during the discussions.

In addition, the Regional Seminar provided a forum to reflect on the Initiative’s activities since its establishment in 2011 and discussed agenda for next Action Plan for 2016-2017. Conclusions from the discussions provided an input to the Initiative’s next Action Plan for 2016–2017.

The seminar was opened by Mr Alexey Stukalo, Deputy Co-ordinator/Head of the OSCE Economic and Environmental Activities; Mr Michel Nussbaumer, Director of EBRD Legal Transition Programme and Ms Caroline Nicholas, Senior Legal Officer, International Trade Law Division, UNCITRAL Secretariat.

Session 1

Mr Michel Nussbaumer; Ms Samira Musayeva, UNCITRAL; Mr Hubert Reisner, Federal Judge, Administrative Court of Austria; Ms Olga Anchishkina, Chairperson of the Public Council of the National Association of Procurement Institutions, Russian Federation, spoke about the role of improving public procurement in economic development and combating corruption.

Session 2

Ms Lisa Miller, Senior Counsel, World Bank; Ms Samira Musayeva; Mr Hubert Reisner discussed safeguarding transparency and accountability in public procurement.

Session 3

Ms Samira Musayeva explained standards for public procurement review in the UNCITRAL Model Law. Mr Hubert Reisner; Mr Michael Fruhmann, Bundeskanzleramt, Austria and Mr Dirk Plutz, Procurement Department, EBRD examined case study: Reasons for success of Austrian public procurement review system.

At the end of the day the EBRD launched Handbook for Public Procurement Review Tribunal.

Session 4

Mr Johannes Schnitzer, EBRD UNCITRAL Initiative Consultant, Ms Lisa Miller and Ms Eliza Niewiadomska, EBRD Legal Transition Programme spoke about the public procurement review and sanctions. At this session the parties explained what type of complaints should be implemented, which sanctions should be applied and what decisions review body should make.

Session 5

This session discussed challenges of establishing national public procurement review systems.
